Terms and Conditions

Last updated: 25 September 2026

Welcome to Hristakiev. These Terms & Conditions govern your use of www.hristakievofficial.com and any purchase made through the website.

Please read these Terms & Conditions carefully before placing an order. By using the website or placing an order, you agree to these Terms & Conditions.

Nothing in these Terms & Conditions limits or excludes any mandatory rights you may have under applicable consumer protection law.

1. ABOUT US

The website www.hristakievofficial.com and the Hristakiev online store are operated by:

Petar Damyanov Hristakiev
Trading as Hristakiev
Self-employed natural person registered in the Republic of Bulgaria
BULSTAT: 181490787
Place of business: ulitsa Chiprovtsi 29, Ruse, Bulgaria
Email: info@hristakievofficial.com

Throughout these Terms & Conditions, "Hristakiev", "we", "us" and "our" refer to Petar Damyanov Hristakiev acting in the course of his independent business activity under the Hristakiev brand.

2. PRODUCTS

Hristakiev designs and sells fashion garments, accessories and related products, including made-to-order, pre-order and artisanal pieces.

We make reasonable efforts to ensure that product descriptions, photographs, measurements, colours, materials and other information displayed on the website are accurate.

Due to differences in screens and devices, actual colours may vary slightly from those displayed online.

Certain products are handmade or incorporate artisanal processes, including leather moulding, weaving or other manual techniques. Small variations in texture, shape, finish, colour or other details may therefore occur. Such natural variations are part of the individual character of handmade products and do not necessarily constitute a defect.

3. SIZING AND CUSTOMISATION

Customers should review the Size Guide before placing an order.

Where available, customers may request minor size customisation by providing measurements or additional instructions when placing the order or by contacting us.

Customers are responsible for ensuring that the measurements and customisation information they provide are complete and accurate.

Where a product is produced specifically according to measurements, dimensions, design alterations or other individual specifications supplied or expressly requested by the customer, it may constitute a customised or personalised product for the purposes of applicable consumer law.

Selection of a standard size, colour or other standard option offered on the website does not by itself necessarily mean that a product is individually customised.

4. ORDERS

By placing an order, you are offering to purchase the selected products in accordance with these Terms & Conditions.

After placing an order, you will receive an electronic confirmation acknowledging receipt of your order.

We reserve the right to refuse or cancel an order before acceptance where reasonably necessary, including in cases of:

  • incorrect pricing or product information;

  • product unavailability;

  • suspected fraud or unauthorised payment;

  • inability to fulfil a requested customisation;

  • delivery restrictions; or

  • another legitimate reason preventing us from fulfilling the order.

If we cancel an order after payment has been received, all amounts due to be reimbursed will be returned using the original payment method.

5. PRICES AND PAYMENT

Prices displayed on the website are stated in the currency shown at checkout.

Applicable taxes will be included or displayed as required by law.

Shipping charges and any other applicable charges will be shown before the customer completes the purchase.

Payment must be made using one of the payment methods available at checkout.

An order will not enter production until the required payment or deposit has been successfully received.

6. PRE-ORDER  AND  MADE-TO-ORDER  PRODUCTS

Many Hristakiev products are produced on a pre-order or made-to-order basis rather than being held as finished stock.

The estimated production or crafting period applicable to a product will be stated on the relevant product page.

Production periods are estimates and may vary depending on the complexity of the product, availability of materials, artisanal production processes and order volumes.

Once the product has been crafted, delivery normally takes approximately 3 to 9 business days, unless otherwise stated on the relevant product page or during checkout.

Where circumstances outside our reasonable control cause a substantial delay, we will inform the customer as soon as reasonably possible.

The fact that a product is described as "pre-order" or "made to order" does not by itself remove any statutory consumer rights.

7. DEPOSITS

Where a product requires a deposit, the applicable deposit amount will be communicated before the order is placed.

The deposit forms part of the total purchase price.

Any provision describing a deposit as non-refundable applies only to the extent permitted by applicable law.

Where a customer has a statutory right of withdrawal requiring reimbursement of the purchase price, we will not retain a deposit contrary to that statutory right.

For genuinely customised or personalised products produced according to the customer's individual specifications, different cancellation and withdrawal rules may apply as described below.

8. SHIPPING AND DELIVERY

Customers must provide a complete and accurate delivery address.

We are not responsible for delays or additional costs resulting from incorrect or incomplete information supplied by the customer.

Estimated delivery periods are provided in good faith but may be affected by courier delays, customs procedures, public holidays, weather conditions and other circumstances outside our reasonable control.

Where mandatory consumer law applies, your statutory rights relating to delivery remain unaffected.

Risk of loss or damage to the goods passes to the customer when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods, except where applicable law provides otherwise.

9. INTERNATIONAL ORDERS, CUSTOMS AND IMPORT CHARGES

Complimentary or free shipping refers only to the cost of transporting the order and does not include import duties, taxes, customs charges or carrier clearance fees. For orders delivered outside the territory in which applicable taxes and duties are collected by us at checkout, the shipment may be subject to import duties, customs charges, taxes or other governmental fees.

Unless expressly stated otherwise at checkout, such charges are the responsibility of the customer.

Customers are responsible for checking any import restrictions or requirements applicable in the destination country before placing an order.

We are not responsible for delays caused by customs authorities.

10. RIGHT OF WITHDRAWAL AND RETURNS

Standard products

Where applicable consumer law provides a statutory right of withdrawal, customers may withdraw from an eligible online purchase within 14 days from the date on which the product is received, without having to provide a reason.

To exercise the right of withdrawal, the customer must notify us clearly of the decision to withdraw by contacting us at:

info@hristakievofficial.com

The customer must then return the goods in accordance with the return instructions provided by us.

Products should be returned unworn, unused and in their original condition, including all labels and packaging where reasonably possible.

Customers may inspect a product to the extent reasonably necessary to establish its nature, characteristics and fit. We reserve the right to reduce the reimbursement where the value of a product has been diminished through handling beyond what is reasonably necessary, to the extent permitted by applicable law.

Return shipping costs

Unless the product is defective, incorrect or we expressly agree otherwise, the customer is responsible for arranging and paying the direct cost of returning the product to us.

We strongly recommend using a tracked and insured shipping service.

The customer remains responsible for the return shipment until it is delivered to us, except where applicable law provides otherwise.

Refunds

Where the statutory right of withdrawal applies, eligible payments will be reimbursed in accordance with applicable consumer law.

Where required by law, this includes the cost of the least expensive standard delivery method offered by us for the original order. Additional delivery charges resulting from the customer's choice of an expedited or more expensive delivery method do not have to be reimbursed.

We may withhold reimbursement until we have received the returned goods or the customer provides evidence that the goods have been sent back, where permitted by law.

Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed.

11. CUSTOMISED AND PERSONALISED PRODUCTS

The statutory right of withdrawal may not apply to goods that are made according to the customer's individual specifications or are clearly personalised.

This may include, where applicable:

  • garments produced according to measurements individually supplied by the customer;

  • individually altered proportions or dimensions;

  • bespoke design modifications requested by the customer;

  • personalised construction or detailing not forming part of the standard product offered on the website; or

  • other products manufactured specifically according to an individual customer request.

Where a product falls within this exception, the customer will be informed before purchase or before the customisation is confirmed where required.

A standard product does not automatically become non-returnable merely because it is manufactured after an order is placed.

Nothing in this section affects the customer's rights where a customised product is faulty, damaged, incorrectly produced or does not conform to the agreed specifications.

12. CANCELLATIONS AND ORDER MODIFICATIONS

If you wish to cancel or modify an order, please contact us as soon as possible.

Because many Hristakiev products are produced specifically after an order is received, we cannot guarantee that a modification will be possible once production has commenced.

Any restriction on cancellation or modification is subject to mandatory consumer rights.

Where a statutory right of withdrawal applies, nothing in this section removes that right.

13. DAMAGED, FAULTY OR INCORRECT PRODUCTS

Please contact us as soon as possible if you receive a product that is damaged, defective, incorrect or materially different from the product ordered.

Please provide your order number together with photographs and a description of the issue where reasonably possible.

Statutory rights relating to defective or non-conforming goods are separate from the right to return an item simply because you have changed your mind.

Where goods are defective or do not conform to the contract, customers are entitled to the remedies available under applicable consumer law.

Where we are responsible for a defective or incorrect product, the customer will not be required to bear return shipping costs where applicable law requires those costs to be borne by us.

14. LEGAL GUARANTEE

Consumers purchasing goods within the European Union benefit from the applicable statutory legal guarantee of conformity.

Nothing in these Terms & Conditions excludes, restricts or replaces rights arising under that legal guarantee.

Any commercial warranty or other additional guarantee that we may voluntarily offer is separate from, and does not limit, statutory consumer rights.

15. PROMOTIONS AND DISCOUNT CODES

Promotional offers and discount codes may be subject to additional conditions communicated at the time of the promotion.

Unless otherwise stated:

  • promotions cannot be combined;

  • discount codes have no cash value;

  • discounts apply only during the stated promotional period; and

  • promotional offers may be withdrawn or modified before an order is placed.

Promotions do not affect statutory consumer rights.

16. INTELLECTUAL PROPERTY

All content appearing on the website, including designs, garments, photographs, graphics, logos, trademarks, text, videos, product names and other materials, is owned by or licensed to Hristakiev unless otherwise stated.

Website content may be viewed and used for personal, non-commercial purposes.

You may not reproduce, distribute, sell, modify, commercially exploit or otherwise use our content without prior written permission, except where such use is permitted by law.

Nothing in these Terms & Conditions transfers any intellectual property rights to the customer.

17. ACCEPTABLE USE OF THE WEBSITE

You must not knowingly use the website:

  • for unlawful or fraudulent purposes;

  • to introduce malware, viruses or other harmful technology;

  • to interfere with the operation or security of the website;

  • to attempt unauthorised access to our systems; or

  • in a manner that infringes the rights of Hristakiev or any third party.

We may restrict access to the website where reasonably necessary to protect the website, our customers or our rights.

18. WEBSITE AVAILABILITY AND ERRORS

We make reasonable efforts to maintain the website and ensure that information is accurate.

However, we cannot guarantee that the website will always be uninterrupted, error-free or continuously available.

We may correct typographical errors, inaccuracies or omissions and may update website content where reasonably necessary.

If an error materially affects an order already placed, we will contact the customer before proceeding wherever appropriate.

19. LIABILITY

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer protection law.

We are not responsible for losses resulting from circumstances outside our reasonable control.

Where you are acting as a consumer, nothing in these Terms & Conditions limits your mandatory statutory rights.

We will not exclude liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

20. FORCE MAJEURE

We will not be responsible for delays or failure to perform obligations caused by circumstances beyond our reasonable control, including natural disasters, serious transport disruption, strikes, governmental restrictions, war, civil disturbance, interruptions in essential utilities, material shortages or significant failures affecting third-party delivery providers.

Where such circumstances materially affect an order, we will take reasonable steps to inform the customer and minimise the effects of the delay.

Mandatory consumer rights remain unaffected.

21. PRIVACY AND COOKIES

Personal information is processed in accordance with our Privacy Policy.

Information about the technologies and cookies used on the website is provided in our Cookie Policy or cookie settings, as applicable.

These policies should be read together with these Terms & Conditions.

22. COMPLAINTS

If you have a complaint relating to an order or our service, please contact us at:

info@hristakievofficial.com

Please include your name, order number and sufficient information for us to investigate the matter.

We will make reasonable efforts to respond and resolve complaints promptly.

Nothing in this section prevents a consumer from using any competent consumer protection authority, alternative dispute resolution mechanism or court available under applicable law.

23. GOVERNING LAW AND JURISDICTION

These Terms & Conditions and contracts concluded through www.hristakievofficial.com are governed by the laws of the Republic of Bulgaria.

If you are a consumer residing in another country, this choice of law does not deprive you of any mandatory consumer protection rights granted to you under the laws that would otherwise be applicable pursuant to European Union and other applicable conflict-of-law rules.

Any dispute arising in connection with these Terms & Conditions or a purchase made through the website shall be subject to the jurisdiction of the competent courts determined in accordance with applicable law.

Nothing in this clause limits a consumer's right to bring proceedings before a court having jurisdiction under mandatory consumer protection rules.

24. SEVERABILITY

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.

25. CHANGES TO THESE TERMS

We may update these Terms & Conditions from time to time to reflect changes to our business, website, services or applicable law.

The version applicable to an order is generally the version made available when that order is placed, unless mandatory law requires otherwise.

The date of the latest update will be displayed at the top of this page.
